If you're a regular here, you've probably been made aware that LuLaRoe has slapped me with a petition that, if granted, would essentially compel me to relinquish my sources to them. Today was the first hearing and where I half expected them not to show up, they not only did, but sent the big brass from Schiff Hardin to come on down. Must have been a hell of a retainer for Schiff Harden to send a partner to a 10 minute long hearing. Way to get those billables, guys. High five. Schiff Hardin is prepared to argue that I am not a journalist. And because I'm not a journalist to them, I don't have the ability to protect my sources. That's basically the gist of their argument. Funny... I guess I just bust out my Holly Hobby notebook and pop-a-point pencils to take imaginary interviews... like the one I just did this evening to clarify the claims that Mark Stidham flew a plane to Puerto Rico... Nah, no journalism happening here at all, fellas. I mean, what baffles the mind here is this complaint is so cut and pasted together, basically a carbon copy of the emailed request for preservation that Lawyer Bill sent me a few months ago. I guess if you've got the mega expensive attorney brass on the case, you shouldn't pay them to actually draw up a complaint with real substance. That would be too costly, I guess. I wonder what the billable hours are for a fancy-schmancy Chicago attorney to drive about an hour and a half to the bumble weeds of McHenry County, IL to appear for a nano second before one of my attorneys said- "Yep, your honor- we're here, and we're going to fight this." That was probably $2,000 right there. Adding insult to injury is that not one but TWO of my attorneys reached out to THREE of LuLaRoe's- all asking for a copy of the complaint- and not a single response was given. Lawyer faux pas 101. The judge asked them to provide us a copy. Fancy brass' response was: "Your client was served a copy." About that... I actually wasn't. Your super duper douchebag process server from the "Hardball" service agency out of Lake Zurich threw the papers at my doorstep after the police told him to leave the property. I was not present and he did not identify or document who he left the service with. If this is any indication of how they play, then I can't wait to play back. So, the court date was set for November 9th and our response will be filed prior. That's really all there is to report. Pretty uneventful day.
